PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a.
All the specific facts and circumstances leading to the applicant’s discharge is not in the available records. However, limited e vidence of record shows that on 20 August 2002, the unit commander recommended separation action under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance (i.e., for violation of UCMJ and Army standards of behavior) with a characterization of service of honorable. Limited evidence of record also shows that an administrative separation board convened to consider the applicant’s involuntary separation action. That Board determined that sufficient evidence was presented to support the applicant’s separation from service by reason of unsatisfactory performance and recommended issuance of a general discharge. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. Her DD Form 214 indicated that she was involuntarily discharged under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance, with a characterization of service of general, under honorable conditions, with a separation code of JHJ, and a RE code of 3.

         b. On 2 April 2003, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 11 months and 29 days of active military service in the period under review and had a total of 18 years, 2 month, and 23 days of total military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(5) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board does not condone the applicant’s incidents of unsatisfactory performance; however, determined that the characterization of service is inequitable. The Board found that the applicant’s unsatisfactory performance was mitigated by service of sufficient merit to warrant an upgrade of the discharge being reviewed. Accordingly, the Board voted to grant partial relief in the form of an upgrade of the characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.

(1-4) The issues are rejected
. Eligibility for veteran's benefits to include educational benefits under the Montgomery GI Bill does not fall within the purview of this Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. See response to issue (5) above.
