SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. All the facts and circumstances pertaining to the applicant’s
discharge proceedings are not contained in the available records. On 5
July 2000, the State of Georgia, Department of Defense, Military Division,
Office of the Adjutant General, Atlanta, Georgia, Orders 187-036,
discharged the applicant from the Army National Guard, effective 5 July
2000, with a general, under honorable conditions discharge, and assigned
him to the USAR Control Group (Reinf), St Louis, Missouri for the remainder
of his statutory obligation. The record contains a properly constituted
NGB Form 22 (Report of Separation and Record of Service). It indicates
that the applicant was discharged under the provisions of Paragraph 1-26k,
Appendix A, NGR 600-200, Transaction Code CW, with a characterization of
service of general, under honorable conditions by reason of unsatisfactory
participation.
b. On 5 July 2000, the applicant was discharged. At the time of
discharge, the applicant had completed 11 months and 27 days of military
service in the period under review and had a total of 5 years and 27 days
of total military service.
2. Legal/Regulatory Basis for Separation Action: National Guard
Regulation (NGR) 600-200 govern procedures covering enlisted personnel
management of the Army National Guard. Paragraph 1-26k, Appendix A (Refer
to AR 135-178, Chapter 13, for discharge by reason of Unsatisfactory
Participation) provides in pertinent part, that individuals can be
separated for being an unsatisfactory participant. Army Regulation 135-91
states that a member is an unsatisfactory participant when nine or more
unexcused absences from scheduled drills occur during a 1-year period.

issue of propriety to change the discharge.

(1) The issue is rejected. The applicant’s record is void of
facts and circumstances concerning the events that led to a discharge from
the Army. The Board noted that the applicant’s record contains a properly
constituted Automated Separation Document in lieu of NGB Form 22 (Report of
Separation and Record of Service). This document identifies the reason and
characterization of the discharge and the Board presumed Government
regularity in the discharge process. The evidence of record shows the
applicant was discharged from the Army National Guard under the provisions
of Paragraph 1-26k, Appendix A, NGR 600-200 by reason of unsatisfactory
participation with a characterization of service of general, under
honorable conditions and transferred to the USAR Control Group (Reinf).
The applicant provided no independent corroborating evidence demonstrating
that either the command's action was erroneous or that the applicant’s
service mitigated his unsatisfactory participation. In the absence of
evidence to the contrary, the Board is satisfied that all requirements of
law and regulation were met and the rights of the applicant were fully
protected throughout the separation process. The Board, being convinced
that the reason for discharge and the characterization of service were both
proper and equitable, voted to deny relief.
