PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 11 February 2002, DA, HQ, U.S. Army Training Center and Fort Jackson, South Carolina, Orders 042-1220 discharged the applicant from the Regular Army, effective date 14 February 2002. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 11, AR 635-200 by reason of entry-level performance and conduct, with an uncharacterized separation of service. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 14 February 2002, the applicant was discharged. At the time of discharge, the applicant had completed 3 months, and 22 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of that regulation provides, in pertinent part that a member may be separated for unsatisfactory performance or conduct, or both, while in an entry-level status. A soldier is in an entry-level status, if before the date of initiation of separation, they have completed no more than 180 days of creditable continuous active duty. Service for soldiers separated under this chapter is uncharacterized.
