PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l1, AR 635-200, by reason of entry level performance and conduct, with service uncharacterized. He was advised of his rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. On 2 October 1997, Orders 275-0006, DA, United States Army Transportation Center; Fort Eustis, VA, discharged the applicant from the regular Army, effective date: 21 April 2000. The complete facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 9 October 1997, the applicant was discharged with an uncharacterized separation of service. At the time of discharge, the applicant had completed 4 months, and 13 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of that regulation provides, in pertinent part that a member may be separated for unsatisfactory performance or conduct, or both, while in an entry-level status. A soldier is in an entry-level status, if before the date of initiation of separation, they have completed no more than 180 days of creditable continuous active duty. Service for soldiers separated under this chapter is uncharacterized.
