PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant’s record is void of the specific facts and circumstances concerning events that led to his discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge as general, under honorable conditions, under the provisions of Chapter 14-12C(2), AR 635-200 for misconduct with an SPD Code of JKK. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 2 April 1998, the applicant was discharged. At the time of discharge, the applicant had 8 months and 8 days, service on his current enlistment and 5 years, 1 month, and 15 days, total time in service.

         c. The applicant was recommended and approved for discharge because of his wrongful use of cocaine. Other than the Article 15 for illegal use of cocaine, the available records indicate the applicant has no other disciplinary infractions under this period of enlistment.

Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the available records for the period of service under review and considered the applicant’s present circumstances. Although the Board sympathizes with the applicant’s present situation and his desire to have his reentry eligibility (RE) code changed, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities, nor is changing RE codes within its purview. Additionally, the Board noted that the applicant’s discharge was approved under the provisions of Chapter 14, Army Regulation 635-200 for misconduct abuse of illegal drugs. The Board determined that the applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in a soldier. The applicant, as a soldier, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and this misconduct diminished the quality of service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
