PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. On 7 March 2001, the applicant was charged with failing to obey a lawful order and for wrongfully touching four enlisted female soldiers in an inappropriate manner. Evidence of record shows that on 19 April 2001, the applicant voluntarily tendered his resignation from the service under the provisions of Chapter 3, paragraph 13; AR 600-8-24, in lieu of trial by general court-martial. The record also shows that the applicant’s chain of command recommended approval of his request for resignation with a characterization of service of under other than honorable conditions (UOHC). The Ad Hoc Review Board recommended that the applicant’s resignation be accepted with issuance of a UOHC. On 16 August 2001, the Deputy Assistant Secretary (Army Review Boards) approved the recommendation of the Army Ad Hoc Review Board and directed that the applicant be discharged with a characterization of UOHC. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 3, AR 635-200 in lieu of trial by general court-martial, with a characterization of service of under other than honorable conditions.

         b. On 11 September 2001, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 3 months, and 5 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 600-8-24 sets for the basic authority for Officer transfers and discharges. Chapter 3 outlines the policy and procedure for the eliminating officer from the active Army for substandard performance of duty, misconduct, moral or professional dereliction, and the interest of national security.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected . The Board carefully examined the available records for the period of service under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record shows the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The Board noted that the applicant voluntarily, and in writing, requested resignation in lieu of trial by general court-martial. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board noted the applicant’s contentions and the documents submitted in support of his contentions; however, the Board did not find said contentions or documents sufficiently compelling to mitigate the characterization of service granted. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
