PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the unit commander initiated the applicant’s separation under the provisions of Chapter 14, Paragraph 14-12c(2), AR 635-200, by reason of misconduct-abuse of illegal drugs on 3 April 2000. On 2 May 2000, DA, HQ, 1
st Corp and Fort Lewis Military Personnel Division, Fort Lewis, Washington, Orders 123-0002 discharged the applicant from the Regular Army, effective date 9 May 2000. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, Paragraph 14-12c(2), AR 635-200 by reason of misconduct, with a characterization of service of general, under honorable conditions. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 9 May 2000, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 2 months, and 7 days of active military service in the period under review and had a total of 4 years, 1 month and 6 days of active military service.

         c. The available records indicate that the applicant had at least three positive urinalysis tests for illegal drugs prior to initiation of his discharge. The applicant had two (2) positive tests for marijuana and one (1) positive test for amphetamines/methamphetamines.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the available records for the period of enlistment under review and the documents submitted with the application . Notwithstanding, that the available record is missing some of the facts and circumstances leading to the applicant’s discharge, the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. This document identifies the reason and characterization of the discharge and the Board presumed Government regularity in the discharge process. Additionally, the available records contain sufficient evidence of misconduct and abuse of illegal drugs to warrant the applicant’s separation by reason of misconduct-abuse of illegal drugs. The Board determined that the applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in a soldier. The applicant, as a soldier, had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of service below that meriting a fully honorable discharge. The Board noted the applicant’s contentions and the documents attesting to his good post service conduct; however, the Board did not find said contentions or good post service conduct sufficiently mitigating to warrant a change to the discharge under review. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
