PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 20 June 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—minor disciplinary infraction, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. The separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge.

         b. On 22 July 1996, the applicant was discharged. At the time of discharge, the applicant had 2 years, 11 months, and 24 days, service on his current enlistment.

         c. The unit commander recommended the applicant be separated from the Army because of his mental status evaluation and several incidents of domestic violence. The applicant was diagnosed with a mixed personality disorder, which was described as a deeply ingrained maladaptive pattern of behavior of long duration that interfered with his ability to perform his duty. It was noted that further violent acting out was possible.


2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) and (2) The issues are rejected. The Board carefully examined the applicant’s record of service for the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, which led to his separation from the Army. The evidence of record does not support the applicant’s contentions and the applicant has provided no independent corroborating evidence in support of them. The evidence of record indicates the applicant was discharged for several incidents of domestic violence against his wife. The applicant's discharge was appropriate because his misconduct was not consistent with the Army's standards for acceptable personal conduct. The applicant’s misconduct diminished the quality of his service below that meriting a fully honorable discharge. The applicant provided no evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated his misconduct. Additionally, the Board determined that the applicant’s separation code appropriately corresponds to his narrative reason for separation. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
