PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 2 December 2001, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l2, AR 635-200, by reason of misconduct-abuse of illegal drugs, with a under other than honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by a board of officers, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service. On 16 July 2002 the applicant was notified to appear before a board of officers, and advised of his rights. The board met; applicant appeared with counsel. The board recommended separation with an under other than honorable conditions. On 28 July 2002, the separation authority recommended approval of the board’s findings and recommendation for separation with a characterization of service of under other than honorable conditions.

         b. On 1 August 2002, the applicant was discharged. At the time of discharge, the applicant had completed 6 years, 11 months, and 21 days of active military service in the period under review and had a total of 22 years, 8 months and 12 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 135-178 (Separation of Enlisted Personnel) provides for the separation of enlisted personnel of the Army Reserve and Army National Guard. Chapter 12, paragraph 12-1 of the regulation, in effect at the time, governed separation for misconduct. When discharged under this provision, Army policy states that the characterization of service will normally be under other than honorable conditions. The regulation also permitted the characterization of service as general, under honorable conditions.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(13) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. While the Board does not condone the applicant’s misconduct, it found that the length and quality of the applicant’s service mitigated his misconduct. In view of the foregoing, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was both proper and equitable and voted not to change it.
