PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 17 November 1993, Orders 264-28, Department of the Army and the Air Force; Oklahoma Army and Air National Guard, 3501 Military Circle, Oklahoma City, Oklahoma, discharged the applicant from the Army National Guard and the Reserve of the Army, effective 16 November 1993. The applicant was not available to sign his NGB Form 22 (Report of Separation and Record of Service). His NGB Form 22 indicates that he was discharged under the provisions of Chapter 8, NGR 600-200, for failure to meet medical procurement standards with an uncharacterized discharge, and a Reenlistment Code: of RE3.

         b. On 16 November 1993, the applicant was discharged. At the time of discharge, the applicant had 8 months, and 1 day, service on his current enlistment under review.

2. Legal/Regulatory Basis for Separation Action : National Guard Regulation (NGR) 600-200 and Army Regulation 135-178 provide the procedures and policies concerning enlisted personnel management and separations of the Army National Guard and Reserve of the Army personnel.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicant’s record contains a properly constituted NGB Form 22 (Report of Separation and Record of Service) which shows the applicant was separated under the provisions of NGR 600-200, paragraph 8-26f, with an uncharacterized discharge, by reason of failing to meet medical procurement standards. Absent evidence to the contrary, the Board presumed government regularity in the discharge process. Further, the Board noted that the applicant was appropriately assigned an RE Code of 3 for a separation by reason of failing to meet medical procurement standards. An RE Code of 3 indicates that the applicant requires a waiver prior to being allowed to reenlist. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
