other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged. Accordingly, your request for
a change in the character and/or reason of your discharge is denied.
You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records. Enclosed are the necessary applications for requesting a
review from both boards. If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.
Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.
If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive. The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness. You may obtain a copy of DoD

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 12 February 1998, State of
Maryland, Military Department, Fifth Regiment Armory, Baltimore, Maryland,
Orders 022-033 MD-STARC-ARP, discharged the applicant from the Army
National Guard and Reserve of the Army, effective 12 February 1998. The
record contains a properly constituted NGB Form 22 (Report of Separation
and Record of Service). His NGB Form 22 indicates that he was discharged
under the provisions of Chapter 8-26g(4), NGR 600-200, by reason of
fraudulent enlistment, with a general, under honorable conditions
discharge. The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.
b. On 12 February 1998, the applicant was discharged. At the time
of discharge, the applicant had completed 1 year and 12 days of military
service and in the period under review and had a total of 2 years, 4 months
and 13 days of military service.
2. Legal/Regulatory Basis for Separation Action: National Guard
Regulation 600-200 sets forth the basic authority for the separation of
National Guard enlisted personnel. Chapter 8, paragraph 26g(4) establishes
policy and prescribes procedures for separating members for fraudulent
entry. Fraudulent entry is the procurement of an enlistment, reenlistment,
or period of service through any deliberate material misrepresentation,
omission, or concealment of information which, if known and considered at
the time of enlistment or reenlistment might have resulted in rejection.
This includes all disqualifying information requiring a waiver.

(1) The issue is rejected. The applicant’s record is void of
facts and circumstances concerning events that led to a discharge from the
National Guard and Reserve of the Army. The Board noted that the
applicant’s record contains a properly constituted NGB Form 22 (Report of
Separation and Record of Service). This document identifies the reason and
characterization of the discharge and the Board presumed government
regularity in the discharge process. The Board noted the applicant’s
contentions; however, in the absence of evidence in the official record,
the Board was unable to determine whether mitigating circumstances exist to
support a change in the applicant’s discharge. The Board, being convinced
that the reason for discharge and the characterization of service were
proper and equitable, voted to deny relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
