PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 2 April 1999, the appropriate authority notified the applicant of initiation of administrative elimination action under the provisions of Chapter 2, AR 600-8-24 by reason of misconduct. The unit commander requested the applicant’s Student Elimination proceedings be reviewed for legal sufficiency and forwarded to the commanding General for signature. On 5 April 1999, CPT, JA, Trial Counsel, reviewed the Student Elimination and release from active Duty proceedings pertaining to the applicant and found them to be legally sufficient. On 9 April 1999, the separation authority directed that the applicant be released and discharged with a general discharge.

         b. On 26 April 1999, the applicant was discharged. He was credited with
11 months and 6 days active service on the enlistment under review.

The unit commander recommended the applicant be discharge from the Army because of his 8-day period of AWOL and his use of cocaine.

2. Legal/Regulatory Basis for Separation Action : Army regulation 600-8-24 prescribes the policies and procedures governing the transfer and discharge of Army officer personnel. Chapter 2, Paragraph 2-37 outlines the rules for processing request for an officer with less 3 years commissioned service will be release from AD and discharged from his/her USAR commissioned when the officer fails to meet the standards of service schools due to: misconduct, moral or professional dereliction, academic or leadership dereliction, resigning from a course.
