SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 8 November 1993, Orders 220-021, State of Michigan, Department of Military Affairs, discharged the applicant from the Michigan Army National Guard and as a Reserve of the Army, effective 20 November 1993. The applicant was not available to sign his NGB Form 22 (Report of Separation and Record of Service). His NGB Form 22 indicates that he was discharged under the provisions of Chapter 8, Paragraph 8-26r, NGR 600-200 by reason of alcohol or other drug abuse rehabilitation failure with a characterization of service of general, under honorable conditions.

         b. On 20 November 1993, the applicant was discharged. He was credited with
8 months and 28 days active service on the enlistment under review.

Legal/Regulatory Basis for Separation Action : National Guard Regulation (NGR) 600-200 and Army Regulation 135-91 govern procedures covering enlisted personnel management of the Army National Guard. Chapter 8 of NGR 600-200 covers, in pertinent part, reasons for discharge and separation of enlisted personnel from the State Army National Guard and/or Reserve of the Army. Paragraph 8-26r of that regulation provides in pertinent part that individuals can be separated for alcohol or drug abuse rehabilitation failure.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, paragraph l, above:

(1) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board noted that the applicant was entitled to a hearing by a board of officers (Administrative Separation Board). Under the provisions of Paragraph 2-4d, Army Regulation 135-178, a soldier with over six years of creditable military service is entitled to a board of officers. The Board found no evidence that the applicant had or waived a board of officers. The Board found the command’s failure to provide the applicant an opportunity to appear before a board constituted a prejudicial error to the rights of the applicant. Accordingly, the Board voted to change the characterization of service to fully honorable and the reason for discharge to Secretarial Authority.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
