PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The evidence of record shows that on 14 February 1992, the Office of the Chief, Plans and Action Branch of the New York State Army National Guard was effecting the applicant’s discharge under the provisions of AR 135-178 by reason of fraudulent entry (i.e., concealment of civilian criminal record). On 6 March 1992, Orders 45-15, Office of the Adjutant General, State of New York, Latham, New York, discharged the applicant from the Army National Guard and the Reserve of the Army, effective 1 April 1992. The applicant was not available to sign his NGB Form 22 (Report of Separation and Record of Service). His NGB Form 22 indicates that he was discharged under the provisions of NGR 600-200 with a characterization of service of general, under honorable conditions.

         b. On 1 April 1992, the applicant was discharged. He was credited with
1 year, 2 months, and 3 days active service on the enlistment under review.

2. Legal/Regulatory Basis for Separation Action : National Guard Regulation (NGR) 600-200 and Army Regulation 135-178 provide the procedures and policies concerning enlisted personnel management and separations of the Army National Guard and Reserve of the Army personnel.

 (2) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The available records do not contain all the facts and circumstances concerning the events that led to his discharge from the Army National Guard and the Reserve of the Army. Notwithstanding, the Board determined that the record contains sufficient documentation to support the command’s action to separate the applicant prior to the expiration of his term of service. The evidence of record shows that the New York State Army National Guard initiated the applicant’s separation under the provisions of AR 135-178 by reason of fraudulent entry (i.e., concealment of civilian arrest record). Further, the record contains a properly constituted NGB Form 22 (Report of Separation and Record of Service) that indicates that the applicant was discharged from the Army National Guard and the Reserve of the Army under the provisions of NGR 600-200 with a general, under honorable conditions discharge. Barring evidence to the contrary, the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
