PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 25 June 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct with a general discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, waived consideration of her case by an administrative separation board, and did not submit a statement in her own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general discharge. On 29 June 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 6 July 1990, the applicant was discharged. At the time of discharge, the applicant had 2 years, 3 months, and 6 days, service on her current enlistment and 5 years, 1 month and 13 days, total time in service.

         c. The unit commander indicated that her reasons for initiating separation action were: consistent behavioral problems; lack of self-discipline; disregard for authority; failure to obey orders; failure to repair; disrespectful behavior; and, two Article 15s.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review . There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The applicant contends that she was not advised of the reasons for her separation from the Army; that she was not given the opportunity to out-process from the Army; and, that she was not provided with a hearing to present evidence in her own behalf. Notwithstanding the applicant’s contentions, the Board found sufficient misconduct and substandard performance to warrant the separation action under review. The evidence of record shows that the command attempted to assist the applicant in performing and conducting herself to Army standards by providing counseling and by the imposition of nonjudicial punishment. She was given at least three rehabilitative transfers. The applicant failed to respond appropriately to these efforts. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies that could lead to separation. Finally, the applicant was present to authenticate her DD Form 214. The applicant's discharge was appropriate because the quality of her service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
