PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 26 July 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement on his behalf. On
4 October 1989, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general, under honorable conditions discharge (GD).

         b. On 23 October 1989, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 1 month, and 10 days of his current enlistment and a total of 4 years of active military service.

         c. The applicant’s record shows that he completed 4 years of service; attained the rank of specialist/E-4; and earned the Overseas Service Ribbon for completing a tour in Korea, and the Air Assault Badge. His disciplinary record includes two Article 15’s: the first 20 January 1989, summarized, for failing to report to post police; and the second on 26 July 1989, for failing to go to his prescribed place of duty which resulted in a reduction to private first class/
E-3. On 22 August 1989, a bar to reenlistment was imposed on the applicant for the Article 15’s outlined above and several incidents of his not being at his appointed place of duty. The unit commander processed the applicant for separation, citing as the basis for taking the action, the applicant’s allowing his personal affairs to adversely impact his duty performance by continually being late for formations or being absent from duty. The unit commander further commented that because all attempts to make him a useful soldier had failed, even after he was given every opportunity to adjust, and after repeated counseling which failed to result in improvement.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.


         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board noted the applicant’s contention, as outlined in his letter accompanying his application, that in effect, his marital problems impaired his ability to serve, and that he was denied a hardship discharge. However, after carefully examining the applicant’s record for the period of enlistment under review, the Board concluded that even if true, the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct which led to the separation action under review. Before initiating action to separate the applicant, the command ensured the applicant was appropriately counseled about the deficiencies which could lead to separation. The Board noted the command made an assessment of the applicant's potential for becoming a fully satisfactory soldier. The evidence of record established that the applicant was afforded a reasonable opportunity to overcome noted deficiencies. As the applicant did not subsequently conform to required standards of discipline and performance, the command appropriately determined the applicant did not demonstrate the potential for further military service. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
