PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 2 February 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, waived legal counsel, was advised of the impact of the discharge action, waived consideration by an administrative separation board, and elected not to submit a statement in his own behalf. The unit commander subsequently recommended separation with a GD. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 10 February 1989, the separation authority directed that the applicant be discharged with a GD.

         b. On 28 February 1989, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 3 months, and 24 days of his current enlistment, and a total of 4 years, 1 month and 24 days of active military service.

         c. The applicant’s record shows that he completed over 5 years of service; that he had attained the rank of specialist/E-4; that he had completed an overseas tour in Korea; and that he earned an Army Achievement Medal, the Overseas Service Ribbon, and the Good Conduct Medal. His disciplinary record includes a conviction by summary court-martial on 29 January 1989, for violating a general regulation and disobeying a noncommissioned officer. He also accepted two Article 15’s: the first on 15 September 1988, for wrongfully allowing an intoxicated person to operate his privately owned vehicle, wrongfully allowing a person to operate an unregistered vehicle, wrongfully allowing a person to operate a POV without a license; and two specifications of failing to go to his prescribed place of duty which resulted in his reduction to the rank of private/E-1; and the second on 2 November 1988 for breaking restriction, intentionally injure himself, failing to go to his prescribed place of duty, being disrespectful to an NCO, disobeying a lawful order, leave his place of duty without proper authority. The unit commander processed the applicant for separation for misconduct citing the offenses outlined above as the basis.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
