PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 13 February 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—abuse of illegal drugs, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, requested treatment in a VA Hospital, and submitted a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 28 February 1989, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 22 March 1989, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 3 years, 7 months, and 9 days of active military service.

         c. The applicant’s record shows that he completed over 3 and ½ years of service; attained the rank of specialist/E-4; and earned a Good Conduct Medal. His disciplinary record includes his acceptance of three Article 15’s: the first on 28 November 1988, for violating a general regulation which included a suspended reduction to private first class/E-3 which was later vacated based on an incident of marijuana use; the second on 9 January 1989, for the wrongful use of marijuana which resulted in his reduction to private/E-1; and the third on
9 February 1989, for the wrongful use of methamphetamine. His disciplinary record also includes two letters of reprimand: the first on 12 January 1989, for not being available to respond to a readiness exercise; and the second on 25 January 1989, for being involved in a verbal altercation. The unit commander processed the applicant for separation by reason of the commission of a serious offense, citing the applicant’s two drug related offenses as the basis for taking the action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, he was young at the time of his discharge and got caught up in loose living; however, he is now older and attempting to raise his standard of living but is unable to because his bad discharge inhibits his ability to gain better employment. However, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. The applicant, by violating the Army's policy not to possess or use illegal drugs, compromised the trust and confidence placed in him as a soldier. As a soldier, he had the duty to support and abide by the Army's drug policies. By abusing illegal drugs, the applicant knowingly risked a military career and diminished the quality of his service below that meriting a fully honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
