PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 12 February 1991, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—minor disciplinary infractions, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, declined legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 15 February 1991, the separation authority directed that the applicant be discharged with a GD.

         b. On 26 February 1991, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 2 years, 6 months, and 26 days of active military service.

         c. The applicant’s record shows that he completed just over 2 and ½ years of service; attained the rank of specialist/E-4; and had earned two Army Achievement Medals. The applicant’s disciplinary record includes his acceptance of an Article 15 on 8 November 1990, for stealing property valued at $60.00; willfully and wrongfully damage property valued at $40.00; wrongfully owning and operating an unregistered privately owned vehicle (POV); operating a POV without a valid license; and failure to obey a lawful order. His punishment included a suspended reduction in rank to private first class/E-3 which was vacated on 8 January 1991. The applicant also had a documented history of financial mismanagement as evidenced by his check cashing privileges being suspended based on his writing three bad checks totaling $414.10. The applicant’s unit commander processed the applicant for separation for a pattern of misconduct citing the disciplinary record cited above as the basis for the action.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The Board noted the applicant’s contention that, in effect, his discharge was improper because he did not understand its affect; and that his decision to get out was based on his dealing with his father’s illness. However, the Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and that the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) and (3) The issues are rejected. The Board noted the applicant’s contentions that, in effect, he has never been in trouble with the law and that he received awards and was recognized as soldier of the year while in the service; and that he knows that if he had stayed in he would have received an honorable discharge. However, the applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board determined that before initiating action to separate the applicant, the command attempted to assist the applicant in performing and conducting himself to Army standards by providing counseling, through the imposition of nonjudicial punishment, and with a rehabilitative reassignment. As the applicant failed to respond appropriately to these efforts, the command appropriately determined he did not demonstrate the potential for further military service.
