PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 10 March 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a recommendation for a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 23 April 1997, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a GD.

         b. On 2 May 1997, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 4 years, 6 months, and 4 days of active military service.

         c. The applicant’s record shows that he completed 4 and ½ years of a 6 years enlistment; attained the rank of specialist/E-4; and that he completed an overseas tour in Germany. His disciplinary record includes his acceptance of a an Article 15 for two specifications of failing to obey a lawful order which resulted in his reduction in rank to private first class/E-3. His unit commander processed him for separation based on a pattern of misconduct, citing the applicant’s delinquency in paying just debts; continually failing to meet uniform standards; his numerous incidents of being late to work; and his violation of barracks visitation policy established by the battalion commander which resulted in his receiving the nonjudicial punishment outlined above.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) and (2) The issues are rejected. The Board noted the applicant’s contentions that, in effect, his discharge did not account for his length and quality of service; and that he received a chapter action that was too severe for the circumstances in his case. However, after carefully examining the applicant’s record for the period of enlistment under review, the Board concluded that the applicant's discharge was appropriate. Further, the Board determined that the applicant’s misconduct clearly diminished the quality of his service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that his service mitigated the misconduct. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
