PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 24 August 1998, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a recommendation for an honorable discharge (HD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and submitted a conditional waiver of his right to have his case heard by an administrative separation board, contingent on his receiving an HD. On 3 September 1998 the intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an HD. The separation authority denied the conditional waiver and returned the action for boarding. On 13 November 1998 an administrative separation board convened, with the applicant and his counsel present, and recommended that the applicant be separated with a general, under honorable conditions discharge (GD). On 5 November 1998, the separation authority approved the findings and recommendations of the administrative separation board and directed that the applicant be separated with an GD.

         b. On 9 December 1998, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 4 years, 9 months, and 1 day of his current enlistment, and a total of 6 years, 9 months, and 27 days of active military service.

         c. The applicant’s record shows that he completed almost seven (7) years of service; the highest rank he attained while on active duty was specialist/E-4; and that he earned an Army Commendation Medal, five (5) Army Achievement Medals, and the National Defense Service Medal. His disciplinary record for the enlistment under review includes his acceptance of an Article 15 for writing
13 bad checks to the Army and Air Force Exchange Service which resulted in his reduction to private/E-2. The unit commander cited the applicant’s unaccountability of his finances as the basis for talking separation action.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

(5) The issue is accepted. There was a full consideration of all service including the infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board took special note of the recommendations for an honorable discharge from both the unit and intermediate level commanders, and determined that the characterization of service was inequitable. The Board concluded that the applicant's generally acceptable personal conduct and performance of duty mitigated his misconduct. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable. The Board determined that the reason for discharge was proper and equitable and voted not to change it.
