PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 29 October 1990, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with an honorable (HD) discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement on his behalf. The unit commander subsequently recommended separation with an HD. On 13 November 1990, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an HD. However, the applicant’s DD Form 214, it is erroneous, states a general discharge.

         b. On 4 December 1990, the applicant was discharged with a general, under honorable conditions discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 2 years, 4 months, and 4 days on his current enlistment and 5 years, 8 months and 9 days total time in service.

         c. The unit commander indicated that the specific reason for processing the applicant for discharge was the applicant's failure of the Army Physical Fitness Test (APFT).

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is accepted. The Board noted that the applicant was discharge under the provisions of Chapter 13, AR 635-200 by reason of unsatisfactory performance due to his failure to pass the Army Physical Fitness Test (APFT). Furthermore, the Board noted that the separation authority approved the applicant's discharge with a characterization of service of fully honorable. However, the characterization of service was improperly changed by an authority involved in the discharge process. Accordingly, the Board voted to grant relief by changing the characterization of service to fully honorable. The Board found that the reason for discharge was proper and equitable and voted not to change it.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
