PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 10 December 1991, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general, under honorable conditions discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, requested a hearing by a board of officers and did not submit a statement on his behalf. The unit commander subsequently recommended separation from the Army. On 28 February 1992, the board of officers met; applicant appeared with counsel. The board recommended separation for unsatisfactory performance with an honorable discharge. On undated, the separation authority directed that the applicant be discharged with an honorable discharge.

         b. On 18 March 1992, the applicant was discharged with an honorable discharge, under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance. At the time of discharge, the applicant had 3 years, 2 months, and 15 days on his current enlistment and 11 years and 2 days total time in service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant's record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. Contrary to the applicant's contention that his separation was based on a single incident in 128 months of service, the evidence of record indicates that the applicant was recommended for separation by his unit commander based on two incidents of communicating indecent language to subordinate female soldiers, reduction in grade, and numerous counseling statements regarding his poor performance, failure to repair and lack of motivation. The Board determined that the applicant's misconduct and poor duty performance did indeed adversely affect the quality of service, bring discredit on the Army, and was prejudicial to good order and discipline. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief. See Paragraph 3, below for response to nondecisional portion of issue.

The Board cannot change the applicant’s reentry eligibility (also known as the reenlistment) (RE) code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance.
