PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
         a. Evidence of record shows that on 15 December 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with an under other than honorable conditions (UOHC) discharge. The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, and requested a hearing by a board of officers. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander(s) reviewed the proposed discharge action and recommended approval of the separation action with a UOHC discharge. On 1 April 1995, the applicant was notified to appear before an administrative separation board of officers, and was advised of his rights. On 4 April 1996, the administrative separation board convened with the applicant and his counsel present. The Board recommended that the applicant be separated from service based on a pattern of misconduct and that he be furnished a general, under honorable conditions discharge (GD). On 2 May 1996, the separation authority approved the findings and recommendations of the administrative separation board and directed the applicant be separated with a GD.

         b. On 17 May 1996, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 10 months, and 28 days of active military service.

         c. The applicant’s record reflects that he completed almost two (2) years of service and that the highest rank he attained while on active duty was private/
E-2. His disciplinary record includes his acceptance of two (2) Article 15’s: the first on 7 August 1995, for disobeying a lawful order which resulted in his reduction to private/E-1; and the second on 10 October 1995, for failure to go to his prescribed place of duty, disobeying a lawful order, dereliction of duty, and making an official statement with the intent to deceive. The applicant’s unit commander processed the applicant for separation and recommended a UOHC discharge, the applicant submitted a conditional waiver contingent on receiving a GD which was denied, and the case was heard by an administrative separation board which recommended separation for a pattern of misconduct with a GD, which was approved by the separation authority.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
