PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 25 August 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 11, AR 635-200, unsatisfactory performance, with an entry level separation (uncharacterized) discharge. The applicant was advised of her rights, acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, and elected not to submit a statement in her own behalf. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. On
9 September 1992, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with an uncharacterized discharge.

         b. On 16 September 1992, the applicant was discharged with an uncharacterized discharge. At the time of discharge the applicant had completed 6 months and 14 days of active military service.

         c. On 21 July 1992 the applicant underwent a mental status evaluation which resulted in her being diagnosed with a phobia to water and a psychiatric clearance for whatever administrative action deemed appropriate by the command. On 25 August 1992 the applicant’s unit commander initiated an entry level separation action on the applicant based on the results of the mental status evaluation. On the date of initiation of the action the applicant had completed 173 days of active duty. The unit commander cited the applicant’s phobia to water as the basis for taking the action, and commented, further, that this condition prevented the applicant from performing the duties of her military occupational specialty (MOS), 88K (Watercraft Operator).

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 11, of this regulation, in effect at the time, provided, for the separation of personnel due to unsatisfactory performance, conduct, or both, while in an entry level status. This provision of regulation applied to individuals who had demonstrated that they were not qualified for retention because they could not adapt socially or emotionally to military life, or because they lacked the aptitude, ability, motivation or self discipline for military service, or that they had demonstrated characteristics not compatible with satisfactory continued service. The separation policy applies to soldiers who cannot meet the minimum standards prescribed for successful completion of training because of lack of aptitude, ability, motivation or self-discipline. The regulation requires uncharacterized service for separation under this chapter.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board noted the applicant’s contention that she was advised that if she had no legal problems her discharge would be changed to a general, under honorable conditions after six (6) months. However, the US Army does not have, nor has it ever had, a policy to automatically upgrade discharges. Each case is decided on its own merits when an applicant submits a DD Form 293 requesting a change in discharge. The Board noted from the evidence of record that the applicant received an uncharacterized separation while in an entry level status (ELS). The separation authority approved the applicant's discharge as entry level status, with the description of service as uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. The purpose of the entry level status is to provide the soldier a probationary period. A general discharge is not authorized under ELS conditions, and an honorable discharge is rarely ever granted for an ELS. A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and his service did not warrant an honorable discharge. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
(2) The issue is rejected. The Army Discharge Review Board cannot change the applicant’s reentry eligibility (RE) code. To obtain a change in an RE code, the applicant should provide supporting documentation to justify any change and submit the request to the Commander, US Army PERSCOM, ATTN: TAPC-EPR-P, 2461 Eisenhower Avenue, Alexandria, Virginia 22331-0450. The evidence of record shows the applicant was correctly assigned an RE code of 3 which applies to persons not qualified for continued Army service, but the disqualification is waivable. To obtain a waiver for reenlistment, the applicant should contact a local Army recruiter for assistance.
