PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 18 October 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of a serious offense, with a general, under honorable conditions discharge (GD). The applicant was advised of his rights, consulted with legal counsel, was advised of the impact of the discharge action, submitted a conditional waiver of his right to a hearing by a board of officers contingent on receiving a GD, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the Army. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a GD. On 26 November 1996, the separation authority directed that the applicant be discharged with a GD.

         b. On 14 January 1997, the applicant was discharged with a GD. At the time of discharge, the applicant had completed 1 year, 9 months, and 5 days of his current enlistment and a total of 9 years, 5 months and 29 days of active military service.

         c. The applicant’s record shows that he completed over 9 years of service; attained the rank of sergeant/E-5; that he completed an overseas tour in Alaska; and that he earned the Army Commendation Medal and two Good Conduct Medals. His disciplinary record for the enlistment under review indicates that he received an Article 15 on 19 September 1996 for disobeying the lawful order of a superior noncommissioned officer, damaging government property, and assault which resulted in his reduction in rank to specialist/E-4. The applicant was barred from reenlistment based on the proceeding incidents with his history of domestic violence offered as supporting factor. The unit commander processed him for separation for commission of a serious offense based on the incidents for which he received the Article 15. The applicant submitted a conditional waiver of his right to a hearing by an administrative separation board, contingent on his receiving a GD and was discharged accordingly.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.
