911101: Unit commander notified the applicant of initiation of separation
action under the provisions of Chapter 14, AR 635-200, for
misconduct, pattern of misconduct. He was advised of his rights.
911106: Applicant acknowledged notification, consulted legal counsel and did
not submit a statement in his own behalf.
911113: Unit commander recommended separation from Service.
911122: Intermediate commander recommended approval with a general under
honorable conditions discharge.
911126: Separation authority waived rehabilitation and approved separation
with a general discharge.
911210: Applicant was discharged.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

b. Equity:      The parenthetical number(s) below correspond(s) to the issue                      number(s) on the DD Form 293, or in Part VI:

(1), (3) The issues are rejected. The applicant's discharge was appropriate because the quality of service at the time of discharge was determined to be inconsistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By misconduct and poor duty performance, the applicant diminished the quality of service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(2) The issue is rejected. Eligibility for veteran's benefits does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance.
