SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances leading to the applicant’s
discharge are not contained in the available records. The record contains
a properly constituted NGB Form 22 (Report of Separation and Record of
Service), indicating discharge under the provisions of NGR 600-200,
paragraph 8-26e(2), by reason of misconduct-drug positive, with a
characterization of service of general, under honorable conditions.
b. On 30 October 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 3 years, 11 months, and 27 days of
military service in the period under review.
c. Although the specific facts and circumstances are not in the
available records the applicant’s statement implies that he “made a huge
mistake and participated in marijuana activity” and that “following drill
he had to take a urine test and he failed it”.
2. Legal/Regulatory Basis for Separation Action: National Guard
Regulation (NGR) 600-200 and Army Regulation 135-178 govern procedures for
the administrative separation of enlisted personnel of the Army National
Guard and Army Reserve. Chapter 8 of NGR 600-200 covers, in pertinent
part, reasons for discharge and separation of enlisted personnel from the
State Army National Guard and as a Reserve of the Army. The regulation,
defines misconduct by reason of one or more of the following: minor
disciplinary infractions, a pattern of misconduct, commission of a serious
offense, abuse of illegal drugs, and conviction by civil authorities.

a. Propriety: The parenthetical number(s) below correspond(s) to

(1) The issue is rejected. The applicant’s record is void of the
specific facts and circumstances concerning the events that led to a
discharge from the Army. The Board noted that the applicant’s record
contains a properly constituted NGB Form 22 (Report of Separation and
Record of Service). This document identifies the reason and
characterization of the discharge and the Board presumed Government
regularity in the discharge process. The evidence of record shows the
applicant was discharged under the provisions of Chapter 8, Paragraph 8-
26e(2), NGR 600-200, by reason of misconduct-drug positive with a general,
under honorable conditions characterization of service. In the absence of
information to the contrary, the Board was satisfied that all requirements
of law and regulation were met and the rights of the applicant were fully
protected throughout the separation process. Further, reenlistment matters
do not fall within the purview of this Board. If the applicant desires to
reenlist, he should contact his local recruiter to determine his
eligibility to reenlist. Those individuals can best advise a former
service member as to the needs of the Army at the time, and are required to
process waivers of RE codes. The Board, being convinced that the reason
for discharge and the characterization of service were both proper and
equitable, voted to deny relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
