PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 24 March 1997, DA imposed a bar to reenlistment under the Qualitative Management Program (QMP) after a comprehensive review of the applicant’s OMPF, and determined that he should be barred from reenlistment. On 27 May 1997, the applicant appealed the bar to reenlistment, QMP, under the provisions of Chapter 16, AR 635-200. DA Standby Advisory Board disapproved the applicant’s appeal of the bar to reenlistment. The unit commander subsequently recommended approval of the discharge action and forwarded it through command channels to the separation authority. The intermediate commander reviewed the proposed discharge action and recommended disapproval. Senior intermediate commander recommended disapproval of the applicant’s appeal. On 22 October 1997, the approval authority disapproved the applicant’s appeal of the DA imposed bar to reenlistment under the provisions of Chapter 16, AR 635-200.

         b. On 28 February 1998, the applicant was discharged with an honorable discharge, under the provisions of Chapter 16, AR 635-200, by reason of reduction in force. He was credited with 2 years, 8 months, and 3 days active service on the enlistment under review and 17 years, 3 months and 26 days total time in service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 16-8 of this regulation sets forth the requirements for early separation of enlisted personnel due to reduction in force, strength limitations, or budgetary constraints. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant's record of service during the period of enlistment under review. The Board noted the applicant’s contentions presented in his counsel’s letter, in effect, that he wants to be reinstated and have his reentry eligibility code changed. The Board is not empowered to return former service members to active duty. The Board may only change the characterization or reason for discharge. If the applicant desires to reenlist, he should contact the local recruiter to determine his eligibility to reenlist. Those individuals can best advise a former service member as to the needs of the Army at the time, and are required to process waivers of reentry eligibility (RE) codes. The evidence of record shows that the applicant was properly discharged under the provisions of Chapter 16, paragraph 16-8, AR 635-200, by reason of reduction in force with an honorable discharge. The applicant has provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant's service mitigated the misconduct or poor duty performance. The Board, being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
