PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 31 March 1998, the applicant was charged with AWOL (980218-980227), stealing cash, two specifications (970801 to 970922), stealing checks, six specifications (970801 to 970922), wrongfully appropriate a vehicle, of a value of $5000.00, the property of SPC (980218), intent to defraud, falsely made in its entirety, a certain checks, five specification (970801 thru 970915), sworn statement, wrongfully and unlawfully (971020). On 4 May 1998, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request, the applicant admitted guilt to the offense, or a lesser included offense. Further, the applicant stated that he understood that he could receive an under other than honorable conditions (UOHC) discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits. The applicant did not submit a statement on his own behalf. The unit commander and intermediate commanders recommended disapproval. On undated, the senior intermediate command approved the discharge with an UOHC discharge. Staff Judge Advocate recommended approved separation with an UOHC. On 20 May 1998, Orders 140-0002, DA, HQ, I Corps and Fort Lewis, Military Personnel Division, Fort Lewis, WA, discharged applicant from the Regular Army, effective date: 10 June 1998.

         b. On 10 June 1998, the applicant was discharged with an under other than honorable conditions discharge, under the provisions of Chapter l0, AR 635-200, in lieu of trial by court-martial. At the time of discharge, the applicant had 2  years, 8 months, and 10 days on his current enlistment and 19 years, 10 months, and 25 days total active military service.

Legal/Regulatory Basis or Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

(1) The issue is rejected. The evidence of record shows the applicant was charged with the commission of an offense punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The Board noted that, after consulting with defense counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. In doing so, the applicant admitted guilt to the stipulated offenses under the UCMJ. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. Finally, the Board considered the applicant’s entire record of service for the period under review. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
