PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 7 February 1996, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—patterns of misconduct, with an under other than honorable conditions discharge. She was advised of her rights. The applicant acknowledged notification, consulted with legal counsel, was advised of the impact of the discharge action, voluntarily waived consideration of her case by an administrative separation board, contingent upon her receiving a discharge no less favorable than general, under honorable conditions and did not submit a statement on her behalf. The unit commander and intermediate commanders recommended approval of the conditional waiver. The senior intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general discharge. On 25 March 1996, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a general discharge.

         b. On 1 April 1996, the applicant was discharged with a general, under honorable conditions discharge. At the time of discharge, the applicant had
1 year, 6 months, and 2 days service on her current enlistment and 8 years,
3 months and 28 days total time in service.

         c. The unit commander indicated that his specific reasons for initiating separation action were: a field grade Article 15 for falsifying official documents and wrongfully cohabiting with a man not her husband; and, a field grade Article 15 for falsifying official documents on six occasions and making a false official statement.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) and (2) The issues are rejected. The record does not support the applicant’s contention that her discharge was inequitable because it was based on double punishment for several minor offenses arising out of the same instance of misconduct. The evidence shows that the applicant first accepted an Article 15 in April 1995 for making a false statement and cohabiting with a man not her husband. In December 1995, she accepted an Article 15 for falsifying 7 official documents. By committing the acts of misconduct, the applicant fell below the accepted standard of conduct expected of a noncommissioned officer and she knowingly risked a military career. This misconduct diminished the quality of service below that meriting a fully honorable discharge. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

(3) and (4) The issues are rejected. The Board acknowledges the applicant's successful transition to civilian life and noted the many accomplishments outlined in her application and/or in the documents with her application. However, in review of the applicant’s entire service record, the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities.
