2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(5) The issue is accepted. The Board noted that the applicant's record contains a DD Form 214, Certificate of Release or Discharge from Active Duty, which was signed by the applicant and indicates the reason and the authority for discharge. The Board further noted, however, that the separation authority, separation code, and narrative reason for separation on the DD Form 214 are incorrect by the evidence of record in the applicant’s file. The applicant was separated under the provisions of AR 635-200, Chapter 10, and blocks 25, 26 and 28 on the applicant’s 214 should read “AR 635-200, Chapter 10”, “KFS”, and “In Lieu of Trial by Court Martial” respectively. The Board determined that the reason for discharge on the applicant’s DD Form 214 was improperly changed by an authority involved in the discharge process.

(1 - 4) The issues are rejected. The applicant's record is void of specific facts and circumstances concerning the events which led to the applicant's discharge. The evidence of record shows the applicant was charged with the commission of offense(s) punishable under the Uniform Code Of Military Justice with a punitive discharge. The Board noted that after consulting with legal counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial. By doing so, the applicant admitted guilt to the offenses of false official statement and forgery. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. Finally, the Board considered the applicant's entire record of service for the period under review. It also noted that the characterization of service for this type of discharge is normally under other than honorable conditions and that the applicant was aware of that prior to requesting discharge. After carefully reviewing the available record, the Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
