890726: Unit commander notified the applicant of initiation of separation       action under the provisions of Chapter 15, AR 635-200, for admission     of homosexuality. He was advised of his rights.
890726: Applicant acknowledged notification.
890731: Applicant consulted legal counsel, voluntarily waived consideration     of his case by an administrative separation board contingent upon        him receiving a characterization of service or description of    separation as under honorable conditions, otherwise referred to as a     “general” discharge, and submitted a statement in his own behalf.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

b. Equity:      The parenthetical number(s) below correspond(s) to the issue                      number(s) on the DD Form 293, or in Part VI:

(1) The issue is accepted. The Board determined that the characterization of service is inequitable. The Board noted that the applicant admitted to homosexual tendencies while a member of the military service and discharge proceedings were properly initiated under the provisions of Chapter 15, AR 635-200. Homosexuality is incompatible with military service and such activity or tendencies seriously impair the accomplishment of the military mission. The Board was satisfied that all requirements of law and regulations were met and the rights of the applicant were fully protected throughout the separation process. However, the Board determined that since the homosexual activities apparently were not prejudicial to the good order and discipline of the military service, that the characterization of discharge should be upgraded to honorable and the Board voted accordingly. However, the Board determined that the reason for discharge was both proper and equitable and voted not to change it.
