(5) Board issues: The separation authority was not proper.

(5) The issue is accepted. A review of the regulations in effect at the time of the applicant’s discharge require a General Court Martial Convening Authority to approve a under other than honorable conditions discharge. There were no provisions in the regulation to delegate this responsibility. The Board determined that the applicant’s discharge authority could only approve a discharge with a general characterization of service. A majority of the Board determined that the applicant’s characterization of service was improper and voted to change it to general, under honorable conditions. A majority of the Board determined that the reason for discharge was both proper and equitable and voted not to change it.
