         930416:  Physical examination cleared applicant for separation.
         930421:  Mental status evaluation cleared applicant for separation.
         930621:  Unit commander notified the applicant of initiation of separation                 action under the provisions of Chapter 13, AR 635-200, for                         unsatisfactory performance. He was advised of his rights.
         930621:  Applicant acknowledged notification, waived legal counsel, and did                not submit a statement in his own behalf.
         930621:  Unit commander recommended separation and requested that the                       rehabilitative transfer requirements be waived.
         930622:  Separation authority waived rehabilitation and approved separation                with a general discharge.
         930628:  Asst. Staff Judge Advocate determined the separation action to be                 legally sufficient.
         930701:  Applicant was discharged.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        
         b. Equity:       The parenthetical numbers below corresponds to the issue numbers on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The record does not support the applicant's contention, and no evidence to support it has been submitted by the applicant, that his work was judged in a biased fashion. The evidence of record reflects that the command attempted to assist the applicant in performing and conducting to Army standards by providing counseling and even by imposition of nonjudicial punishment. The applicant failed to respond appropriately to these efforts. The Board was satisfied that all requirements of law and regulations were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
