THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his Enlisted Record Brief (ERB) to show his home of record (HOR) as Bellefonte, PA.

2.  The applicant states:

	a.  He joined the U.S. Air Force in 2002.  At the time of his enlistment he was residing in Bellefonte, PA.  In 2008, he separated from the Air Force and enlisted in the Regular Army.  When he separated from the Air Force he was stationed at Bolling Air Force Base in Washington, DC.  Since he enlisted in the Army in Washington, DC, his HOR was adjusted to show his Washington, DC, address, which is incorrect.

	b.  His official HOR should be corrected to show Bellefonte, PA.

	c.  He is aware that it has been almost 7 years since the error occurred.  When he first entered the Army he did not notice the error.  He deployed to Iraq in 2009 and when he returned to Fort Stewart, GA, he was placed on orders to Germany.

	d.  He noticed the error when he began his out-processing from the Army.  After multiple attempts through his company S-1, battalion S-1, and brigade S-1, he was informed that any HOR corrections had to be approved by the Army Review Boards Agency.



3.  The applicant provides:

* Pennsylvania driver's license
* Air Force DD Form 214 (Certificate of Release or Discharge from Active Duty)
* DD Form 2058 (State of Legal Residence Certificate)
* Pennsylvania marriage certificate
* AF IMT Form 100 (Request and Authorization for Separation)
* high school diploma

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Air Force on 10 September 2002 and he was honorably discharged on 10 July 2008.  His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows his HOR as Bellefonte, PA.

2.  He immediately enlisted in the Regular Army on 11 July 2008 for 5 years.  Item 3 (HOR) of his DD Form 4 (Enlistment/Reenlistment Document – Armed Forces of the United States) shows an address at Bolling Air Force Base in Washington, DC.

3.  His ERB, dated 17 August 2015, shows his HOR as Bolling Air Force Base in Washington, DC.

4.  He provided copies of his Pennsylvania driver's license; a marriage certificate showing he was married in Bellefonte, PA; a high school diploma showing he graduated in Bellefonte, PA; and an AF IMT Form 100, dated 19 May 2008, showing his HOR as Bellefonte, PA.

5.  Army Regulation 601-280 (Army Retention Program) states the HOR is the place (city and state or country) recorded as the home of the individual when commissioned, appointed, enlisted, inducted, or ordered into the relevant tour of active duty.  The place recorded as the home of the individual when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted, inducted, or ordered into the relevant tour of active duty unless there is a break in service of more than 1 full day.  Only if a break in service exceeds 1 full day, can the HOR be changed by the member.

6.  The Joint Federal Travel Regulation defines HOR as the place recorded as the home of the individual at the time of enlistment or induction.  There is no authority to change the HOR as officially recorded at the time of entry into military service.  However, there is authority to correct an HOR if erroneously entered on the records at that time and then only for travel and transportation purposes.  Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service.  This must be a permanent address.  It may not be a place selected for the convenience of the Soldier.

DISCUSSION AND CONCLUSIONS:

1.  An HOR can be changed to correct a bona fide error.  The applicant's records clearly show his HOR as Bellefonte, PA, when he enlisted in the Regular Air Force in 2002.  He was discharged from the Air Force on 10 July 2008 and immediately enlisted in the Regular Army on 11 July 2008 with no break in active military service.

2.  Since an HOR must be a permanent address, the Bolling Air Force Base address currently shown on his DD Form 4, dated 11 July 2008, is incorrect.  Therefore, it would be appropriate to amend his DD Form 4, dated 11 July 2008, to show his HOR as Bellefonte, PA, and amend his ERB accordingly.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 4, dated 11 July 2008, to show his HOR as Bellefonte, PA, and amending his ERB accordingly.
