THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to change his home of record (HOR) from Hubert, NC to Patterson, NJ.

2.  The applicant states he has prior service in the U.S. Marine Corps (USMC) and did a blue-to-green transfer.  He was approved for a 2-day break in service due to no fault of his own.  Due to his break in service, his duty station was listed as his HOR.

3.  The applicant provides:

* DD Form 4 (Enlistment/Reenlistment Document-Armed Forces of the United States), page 4/1, dated 25 November 2008
* Orders Number 022-0014, dated 22 January 2014
* Personally Procured Move instructions/counseling, dated 24 January 2014
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  The applicant's record contains a DD Form 1966, dated/signed on 
25 November 2008, which shows in:

* Item 3 (Current Address) the entry:  "…Hubert, ONSLOW, NC…"
* Item 4 (HOR Address) the entry:  "…Patterson, PASSAIC, NJ…"

2.  After having had previous enlisted service, the applicant enlisted in the Regular Army on 25 November 2008.  His DD Form 4 shows his HOR as "…HUBERT, (ONSLOW), NC…"

3.  He reenlisted on 29 November 2010.  His DD Form 4 shows his HOR listed as "…HUBERT, NC…"

4.  His Enlisted Record Brief (ERB) shows his HOR as "…Patterson, NJ…"

5.  He was honorably discharged on 27 February 2014.  Item 7b (HOR at Time of Entry) of his DD Form 214 shows his HOR as "…Hubert, NC…"

6.  Army Regulation 601-210 (Regular Army and Army Reserve Enlistment Program) provides the policies and procedures for the preparation of enlistment 
contracts.  It states the HOR address entered on the enlistment contract will be the address declared by the applicant to be his or her permanent home or actual home at the time of enlistment.  A temporary address will not be entered.

7.  The Joint Federal Travel Regulation provides that the HOR is the place recorded as the home of the individual at the time of enlistment or induction.  There is no authority to change the HOR as officially recorded at time of entry into the military service.  However, there is authority to correct a HOR if erroneously entered on the records at that time and then only for travel and transportation purposes.  Correction of the HOR must be based on evidence that a bona fide error was made and the HOR as corrected must have been the actual home of the individual at the time of entry into the relevant period of service.  It may not be a place selected for the convenience of the Soldier.

DISCUSSION AND CONCLUSIONS:

The evidence of record shows the applicant listed his HOR as "…Patterson, PASSAIC, NJ…" on his DD Form 1966 and his current address as "…Hubert, ONSLOW, NC…"  It appears that his current address was inadvertently entered on his DD Form 4, dated 25 November 2008, his DD Form 4, dated 
29 November 2010, and his DD Form 214.  Therefore, the applicant is entitled to correction of his records to shows his correct HOR.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* amending the HOR recorded on his DD Forms 4, dated 25 November 2008 and 29 November 2010, to reflect the HOR address listed on his DD Form 1966
* deleting the current entry in item 7b of his DD Form 214 and replacing it with the HOR address listed on his DD Form 1966
