IN THE CASE OF:
BOARD DATE: 23 April 2015
DOCKET NUMBER: AR20150005848
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests the removal of the DA Form 330 (Language Proficiency Questionnaire) from his official record and the Defense Language Aptitude Battery (DLAB) results from his Officer Record Brief (ORB).
2. The applicant states while he was the company commander at the Defense Language Institute, he and his first sergeant decided they would take the DLAB so they would have a better appreciation of what their Soldiers were going through. He was not advised that it would be posted to his record. He tried to get it removed while at the Defense Language Institute but could not.
3. The applicant provides a copy of a Memorandum for Record, dated 16 June 2014, "SUBJECT: Defense Language Aptitude Battery (DLAB) Results." It shows the applicant completed the DLAB on that date with a standard score of 72.
CONSIDERATION OF EVIDENCE:
1. The applicant, a Regular Army Adjutant General captain, was commissioned a second lieutenant in July 2008 and attended the Adjutant General Officer Basic Course in 2009.
2. The 16 June 2014 Memorandum for Record that the applicant submitted with his application is shown in the service portion of his interactive Personnel Electronic Records Management System (iPERMS) and is identified as DA Form 330. The DLAB score is shown on his ORB as "DLAT 72."
3. Army Regulation 116 (Army Foreign Language Program) provides that officers and warrant officers are to be administered the DLAB at their first active duty branch course or at their first duty station if not attending a basic branch course. The results are forwarded using a memorandum with a subject line of, "DLAB Test Results" and are filed in records in accordance with Army Regulation 600-8-104 (Army Military Human Resource Records Management)
DISCUSSION AND CONCLUSIONS:
1. The applicant should have been administered the DLAB when he attended
Adjutant General Officer Basic Course. Apparently he was not.
2. In any case, the test results belong in his IPERMS and ORB.
3. In view of the foregoing there is no basis for granting the requested relief.
BOARD VOTE:
