THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show his completion of the Primary Leadership Development Course (PLDC).

2.  The applicant states that he completed the PLDC at the 3rd Armored Division Noncommissioned Officer (NCO) Academy.  However, it was not included on his DD Form 214. 

3.  The applicant provides a copy of his DA Form 1059 (Service School Academic Evaluation Report).

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant enlisted in the Regular Army on 28 April 1982 for a period of 4 years, training as a fire support specialist, assignment to the 5th Infantry Division and a cash enlistment bonus.

3.  He completed his one-station unit training at Fort Sill, Oklahoma and was transferred to Fort Polk, Louisiana for his first duty assignment.

4.  On 9 October 1983, he was transferred to Germany for assignment to the 2nd Battalion, 6th Field Artillery Regiment.  He was promoted to the rank of sergeant on 3 April 1985.

5.  On 2 August 1985, he completed the 4-week PLDC at the 3rd Armored Division NCO Academy.

6.  On 21 November 1986, he was honorably released from active duty (REFRAD) due to the expiration of his term of service.  He had served 4 years,   6 months and 24 days of active service and his DD Form 214 issued at the time of his REFRAD shows the entry "None" in item 14 (Military Education).

7.  A review of his official records also shows that he completed the German Headstart course of 1 week in 1983. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant completed the PLDC of 4 weeks in 1985 and the German Headstart course of 1 week in 1983.

2.  Accordingly, those courses should be added to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the entries "German Headstart/1 week/1983" and "PLDC/4 weeks/1985" to item 14 of his DD Form 214.
