THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 31 March 1992 as follows:

2.  He states he was not given the time to bring all of his training, schooling, and awards information for inclusion on his DD Form 214.

3.  He provides:

* six AAM certificates
* two ARCOM certificates
* one MSM certificate
* six achievement certificates
* one service certificate
* 25 training/schooling completion certificates
* DD Form 214, dated 1992

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of 
justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  His military record shows he was inducted into the Army of the United States on 8 April 1971.  He completed training and he was awarded military occupational specialty 76Y (Supply Specialist).  He was honorably discharged on 19 February 1973 for the purpose of immediate reenlistment.  His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) lists the National Defense Service Medal.  Item 25 (Education and Training Completed) of this form lists the entry, "None."

3.  He reenlisted in the Regular Army (RA) on 20 February 1973 for 3 years.  He was honorably discharged on 15 January 1976 for the purpose of immediate reenlistment.  His DD Form 214 (Report of Separation from Active Duty) lists the National Defense Service Medal and Army Good Conduct Medal.  Item 
27 (Remarks) of this form contains the entry, "Military Schools Attended: Yes, 1 week, 1973."

4.  He reenlisted in the RA on 16 January 1976 for 3 years.  He was honorably discharged on 26 April 1978 for the purpose of immediate reenlistment.  His 
DD Form 214 lists the National Defense Service Medal and Army Good Conduct Medal (2nd Award).  Item 27 of this form contains the entry, "Military Schools Attended This Period:  None."

5.  He reenlisted in the RA on 27 April 1978.  He served in:

* Germany from 10 October 1978 through 22 October 1980 and from 26 August 1984 through 5 November 1987
* Saudi Arabia from 10 August 1990 to on or about 18 April 1991

6.  He was honorably retired on 31 March 1992.  He was credited with completing a total of 20 years, 11 months, and 24 days of net active service and no time lost.  His DD Form 214 shows in:

10.  He provided copies of the following certificates awarding him the AAM for:

* exceptionally meritorious achievement from 28 February to 31 March 1987
* outstanding achievement during the period 25 April to 6 May 1988
* meritorious achievement during the period 29 July to 16 August 1988
* outstanding achievement form 18 March to 1 April 1990


11.  He also provides copies of the following certificates awarding him the ARCOM for:

* exceptionally meritorious service from August 1984 to October 1987
* meritorious achievement from 14 March 1990 to 8 April 1990
* exceptionally meritorious achievement while serving during Operation Desert Shield/Storm

12.  He further provides a copy of a certificate, dated 31 January 1992, awarding him the MSM for exceptionally meritorious service during a distinguished 20-year career.  This document contains Permanent Order Number 15-8, issued by Headquarters and Headquarters Company, Division Support Command. 

13.  A review of his records failed to reveal any orders authorizing him additional awards of the AAM, ARCOM, and/or MSM.

14.  Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It established standardized policy for the preparation of the 
DD Form 214.  It stated for:

	a.  item 13, list awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards).  Certificates of Achievement, Service, or Appreciation are not reflected.

	b.  item 14, the entering of in-service training courses is accomplished to assist Soldiers after separation in job placement and counseling; therefore, training courses for combat skills will not be listed.  Those authorized training courses successfully completed during the period of service covered by the
DD Form 214 will include the title, length in weeks (1 week or more), and year completed.  Correspondence courses are not reflected.

15.  Army Regulation 600-8-22 (Military Award) states:

	a.  Service in the Persian Gulf War is recognized by award of the SWASM to Army members who participated in Operations Desert Shield/Desert Storm in the designated area on or after 2 August 1990.  A bronze service star is authorized for the Defense of Saudi Arabia (2 August 1990 through 16 January 1991), Liberation and Defense of Kuwait (17 January through 11 April 1991), and Southwest Asia Cease-Fire (12 April 1991 through 30 November 1995) campaigns.

	b.  The KLM awarded by the Kingdom of Saudi Arabia (KLM-SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991.

   c.  The KLM awarded by the Government of Kuwait (KLM-KU) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record confirms the applicant successfully completed the following courses and as a result, he is entitled to addition of these courses to item 14 of his DD Form 214 for the period ending 31 March 1992:  

* German Headstart, 2 weeks, 1978
* Organizational Supply Procedures Course, 2 weeks, 1979
* Supply NCO Advanced Course, 10 weeks, 1981
* Division Logistics Systems Course (Phase 1), 3 weeks, 1981
* Direct Support Unit Standard Supply System (DS4), 5 weeks, 1982
* Logistics and Management Development Course, 1 week, 1984
* German Headstart, 2 weeks, 1984
* Logistics Management College - The Marquee, 2 weeks, 1990

2.  Regulatory guidance provides for the listing of in-service training course successfully completed during the period of service covered by the 
DD Form 214.  Therefore, he is not entitled to correction of the DD Form 214 dated 1992 to show the following courses:

* Crave Vocation School - Carpentry, 2 years, 1969
* Bradley Leader Course, 1 week, 1969
* College of Police, 1 year, 1973

3.  There are also no regulatory provisions for listing extension courses on the 
DD Form 214.  Therefore, there is no basis for granting this portion of his request.

4.  The evidence of record shows he served in three campaigns during his deployment to Southwest Asia and was awarded the SWASM with two bronze service stars.  Therefore, he is entitled to one additional service star to be affixed to his already awarded SWASM.  Based on this service he is also entitled to award of the KLM-SA and KLM-KU.  Therefore, he is entitled to a correction of his DD Form 214 to reflect these awards.

5.  Permanent orders awarded him the MSM which is not shown on his DD Form 214.  As such, he is entitled to addition of this award.  

6.  With respect to additional awards of the MSM, there is no evidence of record and he provides none to show he was awarded more than one MSM.  Therefore, there is an insufficient evidentiary basis for granting this portion of his request.

7.  With respect to additional awards of the AAM:

	a.  The evidence of record shows the applicant was awarded a total of six awards of the AAM which are currently shown on his 1992 DD Form 214.

	b.  There is no evidence of record and he did not provide any evidence that shows he was awarded any additional awards of the AAM.  Therefore, his 
DD Form 214 for the period ending 31 March 1992 correctly shows the number of AAMs he is entitled to.  

8.  With respect to additional awards of the ARCOM, evidence of record shows orders awarded him two awards of the ARCOM and his DD Form 214 shows these awards.  There is no evidence of record and he provides none to show he was awarded a third award of the ARCOM.  Therefore, there is an insufficient evidentiary basis for granting this portion of his request.

9.  There are no regulatory provisions for listing Certificates of Achievement, Service, or Appreciation on the DD Form 214.  Therefore, there is no basis for granting this portion of his request.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 31 March 1992 by:

* deleting the SWASM with two bronze service stars 
* adding the following awards:

* MSM
* SWASM with three bronze service stars
* KLM-SA
* KLM-KU

* adding to Item 14 of his 1992 DD Form 214:

* German Headstart, 2 weeks, 1978
* Organizational Supply Procedures Course, 2 weeks, 1979
* Supply NCO Advanced Course, 10 weeks, 1981
* Division Logistics Systems Course (Phase 1), 3 weeks, 1981
* Direct Support Unit Standard Supply System (DS4), 5 weeks, 1982
* Logistics and Management Development Course, 1 week, 1984
* German Headstart, 2 weeks, 1984

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to:

* adding to additional awards of the AAM, ARCOM, and his appreciation and service certificates to his DD Form 214
* adding the following courses to his DD Form 214:

* Crave Vocation School - Carpentry, 2 years, 1969
* Bradley Leader Course, 1 week, 1969
