THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the first three digits of his social security number (SSN) as 391.
2. The applicant states that his DD Form 214 incorrectly reflects the first three digits of his SSN as 391 instead of 397.
3. The applicant provides copies of his DD Form 214 and military records.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. He was inducted into the Army of the United States on 5 December 1966.
3. On 15 April 1968, he was transferred to Thailand where he remained until
22 November 1968, when he was transferred to Oakland Army Base, California where he was honorably released from active duty (REFRAD) on 24 November 1968 as an overseas returnee. His DD Form 214 issued at the time of his REFRAD shows his SSN beginning with the first three digits as 397.
4. The available evidence contains a DD Form 398 (Statement of Personal History) and a DA Form 2962 (Security Termination Statement and Debriefing Certificate), dated 18 November 1968, both list his SSN with the first three digits of 391.
DISCUSSION AND CONCLUSIONS:
1. The applicants contention that his DD Form 214 incorrectly reflects the first three digits of his SSN as 397 instead of 391 has been noted and found to have merit.
2. The applicant used the SSN beginning with the first three digits of 391 during his period of service.
3. Accordingly, his DD Form 214 should be corrected to show the first three digits of his SSN as 391.
