THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show the first three digits of his social security number (SSN) as 316.
2. The applicant states his DD Form 214 incorrectly reflects the first three digits of his SSN as 310 instead of 316.
3. The applicant provides copies of his DD Form 214 and National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service).
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Indiana Army National Guard (INARNG) on
7 March 1965 for a period of 6 years. At the time of his enlistment his records were prepared to reflect an SSN beginning with the first three digits of 316.
3. He was ordered to active duty training (ADT) on 5 December 1965. He completed his basic training at Fort Knox, Kentucky and his advanced individual training at Aberdeen Proving Ground, Maryland and was honorably released from ADT on 29 May 1966. His DD Form 214 issued at the time shows his SSN in item 32 (Remarks) beginning with the first three digits of 310.
4. On 6 March 1971, the applicant was honorably discharged from the INARNG and as a Reserve of the Army. His NGB Form 22 shows the SSN he states is correct.
DISCUSSION AND CONCLUSIONS:
1. The applicant enlisted using the SSN that begins with the first three digits of 316 and served all of his service under that SSN.
2. However, at the time of his release from active duty, an administrative error occurred which resulted in the first three digits of his SSN being depicted as "310" on his DD Form 214.
3. Accordingly, his DD Form 214 should be corrected to show his SSN beginning with the first three digits 316."
