		IN THE CASE OF:

		BOARD DATE: 30 June 2015

		DOCKET NUMBER: AR20140017104

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests that he be promoted to the pay grades of E-6 and E-7.

2. The applicant states he made the rank of staff sergeant in 2009 when he received his recruiter ring; however, he was told that as a retiree recall he could not be promoted. He did the best he could and he should have been promoted.

3. The applicant provides a one-page letter explaining his application, ten letters of support, and a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1. The applicant was on the Army of the United States (AUS) Retired List in the rank of sergeant (SGT) when he was recalled to active duty on 26 October 2008.

2. He remained on active duty until he was again retired by reason of completion of required active duty on 26 February 2014. He had served 20 years, 4 months, and 8 days of active service and was again retired in the rank of SGT.

3. Army Regulation 601-10 (Management and Recall to Active Duty of Retired Soldiers of the Army in Support of Mobilization and Peacetime Operations) provides in paragraph 2-4d (Active Duty Grade and Promotion) that retired military personnel recalled to active duty in a retired status are not eligible for promotion.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s contentions and supporting documents have been carefully considered; however, the applicable regulation provides that retirees recalled to active duty are not eligible for promotion.

2. Therefore, there appears to be no error or injustice in his case and no basis to grant his request.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____X____ ____X____ ___X_____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

2. The Board wants the applicant and all others concerned to know that this action in no way diminishes the sacrifices made by the applicant in service to the United States during the Global War on Terrorism. The applicant and all Americans should be justifiably proud of his service in arms.

He goes on to state that he was promoted to the rank of MG and he was retired in the rank of MG on 30 November 1998. In accordance with Title 10, U.S. Code (USC), Section 1402, which governs the recomputation of military retired pay, DFAS was only authorized to recognize active duty retirees as having an entitlement to change in grade upon subsequent retirement. The law at the time the applicant was recalled to Reserve service did not include entitlement to recomputed retired pay for...

Army Regulation 600-8-29 states the active duty service obligation is a specific period of active duty an officer must serve before being eligible for voluntary separation or retirement. The applicant provided a copy of an excerpt of Army Regulation 600-8-29 that states he required 6 months of active duty service in the grade of MAJ to be retired at that grade. The evidence shows he did not earn any active duty retirement points as a MAJ prior to his retirement date.

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant states, in effect, that the FSM’s DD Form 214, dated 30 September 1955, shows his rank as "SFC" but his retired pay account statement shows "SSG." The FSM's Military records contain a copy of a DD Form 424 (Certification of Information for Retired Pay), dated 2 September 1955, which shows the rank and grade in which he retired was "SFC (E-6)."

The applicant requests correction of his military records to show that he was voluntarily recalled to active duty in the rank of lieutenant colonel (LTC), pay grade O-5. Army Regulation 600-8-24 (Officer Transfers) provides, in pertinent part, that a commissioned officer must serve on active duty for 3 years in grade to retire in a rank above MAJ and below lieutenant general. The evidence clearly shows that the applicant was voluntarily recalled to active duty as a retiree in his retired...

The applicant requests, in effect, his records be corrected to show he was recalled to active duty (AD) in the grade of lieutenant colonel (LTC/O-5) vice major (MAJ/O-4). A retired Soldier recalled to AD will normally be ordered to AD in their current grade on the retired list. There is no evidence to show he was promoted to LTC before he retired.

During the original review of this case it was determined the applicant voluntarily requested and was granted retirement in the rank of major prior to completing the 3 years of service as an LTC as required by law to retire in that grade. Further, the evidence fails to support a conclusion the family considerations that resulted in him declining his overseas assignment and requesting retirement rose to the level of extreme hardship, or exceptional or unusual circumstances, at the time he...
