THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 be corrected to show his airborne qualifications.
2. The applicant states that his DD Form 214 does not reflect his airborne qualifications which will affect his injured knee claims.
3. The applicant provides no additional documents with his application.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 30 June 1988 for a period of 4 years and training as a printing and bindery specialist. He completed his basic training at Fort Dix, New Jersey and his advanced individual training at Fort Belvoir, Virginia before being assigned to Fort Bragg, North Carolina for his first and only assignment.
3. On 2 June 1989, he completed the 3-week Basic Airborne Course at Fort Benning, Georgia. He was awarded the Parachutist Badge and a Special Qualification Identifier (SQI) of P.
4. On 29 June 1992, he was honorably released from active duty (REFRAD) due to the expiration of his term of service (ETS). He had served 4 years of active service and his DD Form 214 issued at the time of his REFRAD shows no evidence of his award of the Parachutist Badge or completion of the Basic Airborne Course.
DISCUSSION AND CONCLUSIONS:
1. The applicants contention that his DD Form 214 does not reflect his airborne qualifications has been noted and found to have merit.
2. While the applicants SQI is reflected on his DD Form 214, his award of the Parachutist Badge and completion of the 3-week basic airborne course in 1989 are not reflected on his DD Form 214.
3. Accordingly, his DD Form 214 should be corrected to add the award of the Parachutist Badge and completion of the Basic Airborne Course of 3 weeks in 1989.
