THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his records to show he was authorized Board Certification Pay (BCP) retroactive to the beginning of calendar year 2011.

2.  The applicant states the Army Medical Department, Special Pay Branch can correct back 11 months, but Board action is required beyond 11 months.  In 2010 his board certification in Family Medicine was extended to 2013 by the American Board of Family Medicine (AFBM) when the AFBM transitioned to a ten-year certification process.  Copies of this update were forwarded through clinical and administrative channels but were not updated through finance.  The new  recertification was completed in March 2013, but again this document was not forwarded to finance.  BCP was discontinued 1 January 2011 even though his board certification was current and active.

3.  The applicant provides copies of –

CONSIDERATION OF EVIDENCE:

1.  The applicant, a Regular Army (RA) Medical Corps colonel with a date of rank of 16 June 2011, stopped receiving BCP at the end of 2010.

2.  In the processing of this case, an advisory opinion was obtained from the Chief, Army Medical Department, Special Pay Branch, Office of The Surgeon General (OTSG), Falls Church, VA.  The advisory official:

	a.  Recommends administrative relief.

	b.  States that requests for BCP are initiated by the officer through their supporting Human Resources Office.

		(1)  States a review of available personnel and pay records indicate the applicant's BCP payments were restarted on 1 July 2013 with an expiration of 31 December 2023.

		(2)  States the applicant did not receive BCP for the period 1 January 2011 through 30 June 2013; however, he was eligible to receive BCP for this period.

	c.  Based on the applicant's Medical Service Pay Date of 13 June 1997 for the pay rate level, the total retroactive payment for this period is approximately $14,458 prior to taxes; however, the exact payment is to be determined by the Defense Finance and Accounting Service (DFAS).

4.  The applicant was provided a copy of the advisory opinion in order to allow him the opportunity to submit comments or a rebuttal.  He did not respond.

DISCUSSION AND CONCLUSIONS:

1.  Records show the applicant was serving on active duty and was board-certified in Family Medicine during the period of service under review.

2.  For reasons that are not clear, but apparently due to administrative error, the applicant was not paid BCP during the period beginning 1 January 2011 through 30 June 2013.  His BCP was reinstated retroactive to 1 July 2013.

3.  The OTSG cannot authorize the missing payment because it would exceed OTSG's authority.

4.  Therefore, in view of the foregoing, it would be appropriate to correct the applicant's records to show entitlement to BCP for the missing period.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant applied for and was approved to receive Board Certification Pay effective 1 January 2011 through 30 June 2013.

2.  DFAS should remit any payment of BCP due the applicant as a result of this correction.
