		IN THE CASE OF:

		BOARD DATE: 3 March 2015

		DOCKET NUMBER: AR20140010427

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he entered active duty on 14 February 2012 instead of 14 February 2010.

2. He states the date recorded on his DD Form 214 is in error because this is not the date he entered the service.

3. He provides no additional documents.

CONSIDERATION OF EVIDENCE:

1. The applicant's DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States) shows he enlisted in the U.S. Army Reserve under the delayed entry program on 25 July 2011 and he enlisted in the Regular Army on 14 February 2012.

2. His Enlisted Record Brief shows his pay entry basic date and basic active service date as 14 February 2012.

3. He was retired from active duty on 23 April 2013 by reason of physical disability.

4. He was issued a DD Form 214 which shows he entered active duty on 14 February 2010 and was medically retired on 23 April 2013. This is 3 years, 2 months and 9 days of active military service. This DD Form 214 indicates he completed 1 year, 2 months, and 10 days of active duty service.

5. Army Regulation 635-5 (Separation Documents) governs the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. It directs that the beginning date of the continuous period of active duty will be entered in item 12a (Date Entered Active Duty This Period) for issuance of a DD Form 214 for which a DD Form 214 was not previously issued.

DISCUSSION AND CONCLUSIONS:

1. The applicant's enlistment contract confirms he entered active duty on 14 February 2012. However, his DD Form 214 reflects he entered this period of active duty on 14 February 2010.

2. The applicant was medically retired on 23 April 2013 and he completed 1 year, 2 months, and 20 days of active duty this period. It appears the applicant's date of entry on active duty for this period is erroneously entered in item 12a of his DD Form 214.

3. Therefore, it would be appropriate to amend item 12a of the applicant's DD Form 214 to show he entered active duty on 14 February 2012.

BOARD VOTE:

___X_____ ___X_____ ___X_____ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the entry "2010 02 14" from item 12a of his DD Form 214 and adding the entry "2012 02 14."

If the day is the 31st day of the month, then change it to 30. When computing creditable service, consider each month as consisting of 30 days regardless of the actual number of days in the month, except when the period of active service ends on 28 February of a leap year; do not change the 28 to 30 since the 29th is the last day of the month. The applicant's last day of service was 18 June 2012, not 28 February 2012.

The available evidence shows the applicant received properly-constituted DD Forms 214 for her periods of active service from 12 November 2007 to 8 September 2009 and from 28 October 2011 to 21 September 2012.

Order 105-010, issued by the MNARNG on 14 April 2004, ordered him to active duty during the period 19 April through 4 September 2004, under the authority of Title 32, USC, section 502 (f). This period of active duty is not shown on his DD Form 214 for the period ending 18 July 2003; therefore, item 12a should be corrected to show he entered active duty on 27 May 2002, and item 12c should also be...

The applicant requests correction of item 12a (Date Entered Active Duty (AD) This Period) of his DD Form 214 (Certificate of Release or Discharge from Active Duty). The applicant requests that her entry date on active duty be corrected to show 29 September 1994. Her DD Form 214 effective 5 February 1995 shows that she entered active duty on 29 September 2009 which is an apparent error; therefore, it would be appropriate to correct item 12a of her DD Form 214 to show the entry "94 09 30"...
