		BOARD DATE: 7 May 2013

		DOCKET NUMBER: AR20120019276

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, that his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 31 August 2012, be corrected to show in block 12a the correct date he entered active duty.

2. The applicant states his DD Form 214 reflects the date he enlisted in the U.S. Army Reserve (USAR) instead of the date he entered active duty in the Regular Army.

3. The applicant provides a copy of his DD Form 214 dated 2 July 1991.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the USAR on 10 January 1991 for a period of
8 years. He was ordered to active duty for training (ADT) on 24 January 1991 and served on active duty until he was honorably released from ADT on 2 July 1991 and was returned to his USAR unit. He had served 5 months and 9 days of active service.

2. On 4 February 1993, he enlisted in the Regular Army and continued to serve through continuous reenlistments. He was promoted to the pay grade of E-6 on 1 March 2003.

3. On 31 August 2012, he was retired and was transferred to the Retired List effective 1 September 2012. He had served 20 years and 6 days of active service.
4. At the time of his retirement his DD Form 214 was prepared to reflect in block 12a that he entered active duty on 10 January 1991 instead of
4 February 1993.

5. Army Regulation 635-5 (Separation Documents) serves as the authority for the preparation of the DD Form 214. It provides, in pertinent part, to enter in Part 12a the beginning date of the continuous period of active service for issuance of the DD Form 214 for which a previous DD Form 214 was not previously issued.

DISCUSSION AND CONCLUSIONS:

1. The applicant’s contention that his DD Form 214 incorrectly reflects the date he enlisted in the USAR instead of the date he entered active duty in the Regular Army has been noted and found to have merit.

2. The applicant enlisted in the USAR on 10 January 1991 and he enlisted in the Regular Army on 4 February 1993 and served on active duty until he was retired on 31 August 2012.

3. However, at the time of his retirement his DD Form 214 was prepared to reflect that he entered active duty on 10 January 1991 instead of 4 February 1993. Accordingly, his DD Form 214 should be corrected to reflect in block 12a that he entered active duty on 4 February 1993.

BOARD VOTE:

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* Deleting the entry “1991  01  10” from block 12a of his DD Form 214 dated 31 August 2012
* Adding the entry “1993 02 04” to block 12a of his DD Form 214
2. The Board wants the applicant and all others to know that the sacrifices he made in service to the United States are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.

The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of entry on active duty as 27 December 2002 instead of 27 December 2003. The evidence of record shows the applicant was ordered to active duty on 27 December 2002 for a period of 365 days that was later changed to 470 days. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge.

At the time he had completed 3 years of net active service this period.
