		IN THE CASE OF:

		BOARD DATE: 24 February 2015

		DOCKET NUMBER: AR20140010083

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of the Board's earlier decision to grant him the Officer Accession Bonus (OAB) rather than the Student Loan Repayment Program (SLRP).

2. The applicant states that, because of previous payments he made towards his student loans, the OAB is actually more financially beneficial to him.

3. The applicant provides a copy of his student loan account showing a remaining balance of $7,918.13 as of 4 June 2014.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20130008094 on 19 December 2013.

2. The Board considered the applicant's request to be paid both the OAB and the SLRP with the available evidence. The Board concluded that the applicant had erroneously been promised both incentives. Although he was eligible for either, by law he could not receive both.

3. The Board noted that the SLRP authorized a $20,000 total and the OAB a $10,000 total. It concluded that the SLRP was more financially advantageous to him.
DISCUSSION AND CONCLUSIONS:

1. The applicant's SLRP unpaid balance as of 4 June 2014 is $7,918.13. SLRP payments are not made to individuals but to institutions. As the OAB is $10,000.00, at this point in time it is more financially advantageous to the applicant.

2. Therefore, the previous decision should be amended to show the applicant chose to receive the OAB.

BOARD VOTE:

____X___ ____X___ ____X___ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20130008094, dated 19 December 2013. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a. showing he elected the OAB when he enlisted in the USAR on 7 August 2009; and

   b. authorizing payment of the OAB by the Defense Finance and Accounting Service.

       	   CHAIRPERSON

I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

The applicant received a $10,000.00 OAB and $12,000.00 under the SLRP. (2) If the applicant had been receiving the SLRP, she would not have been eligible for the OAB. Having already enlisted, the applicant was not eligible to receive SLRP at the time she did; therefore, the $12,000.00 should be recouped.

The applicant requests reinstatement of his Officer Accession Bonus (OAB) with a forgoing of his Student Loan Repayment Program (SLRP); or grant him relief from the collection of the OAB with continued payments under the SLRP. The applicant's SLRP addendum clearly states that if he received a commission he would still retain his SLRP entitlement. Therefore, it is appropriate to correct the applicant's records to show he terminated his enlisted SLRP option in favor of accepting the OAB.
