THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to reflect his completion of the Methods of Instruction course.
2. The applicant states that his completion of the Methods of Instruction (MOI) course was omitted from his DD Form 214.
3. The applicant provides copies of the Certificate of Training for the MOI course and his
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was inducted on 21 June 1968. He completed his basic training at Fort Jackson, South Carolina and his advanced individual training as a medical specialist at Fort Sam Houston, Texas and remained at Fort Sam Houston as an instructor.
3. On 1 June 1969, he was transferred to Vietnam and remained in Vietnam until 1 June 1970, when he was transferred to Oakland Army Base, California where he was honorably released from active duty (REFRAD) on 2 June 1970 as an overseas returnee. He had served 1 year, 11 months and 12 days of active service and his DD Form 214 issued at the time of his REFRAD shows he completed LPC TNG of 2 weeks in 1968 and MED CORPSMAN training of 10 weeks in 1968.
4. A review of his official records failed to show his attendance at the MOI course or the duration of the course. Additionally, the certificate provided by the applicant does not indicate the period/duration of the course.
5. Army Regulation 635-5 at the time stated to enter installation training courses, military correspondence courses, and off-duty courses the enlisted person has completed successfully during the period covered by the DD Form 214.
DISCUSSION AND CONCLUSIONS:
The applicant has provided a certificate showing that he completed the MOI course in 1968. It would be appropriate to enter this course on his DD Form 214.
