IN THE CASE OF:
BOARD DATE: 4 September 2014
DOCKET NUMBER: AR20140002115
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his Social Security Number (SSN) as XXX-XX-3XXX instead of XXX-XX-4XXX.
2. The applicant states he was detained for two days at Fort Jackson, South C so the SSN error could be corrected; however, he recently noticed it is still incorrect on his DD Form 214.
3. The applicant provides copies of his:
* Social Security and MEDICARE Cards both showing his SSN as XXX-XX-3XXX
* DD Form 214 showing his SSN as XXX-XX-4XXX
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was inducted on 2 May 1967. At that time, Soldiers were assigned Army service numbers for identification purposes.
3. His record contains the following documents showing the SSN as shown on his Social Security Card, XXX-XX-3XXX, the number he claims is correct:
* DD Form 398 (Statement of Personal History), dated 2 May 1967
* DA Form 3027 (U.S. Army Request for National Agency Check), dated
3 May 1967
4. He was honorably released from active duty on 1 May 1969. Item 3 (SSN) of his DD Form 214 shows his SSN as XXX-XX-4XXX.
5. Army Regulation 635-5 (Separation Documents) in effect at the time established the standardized policy for preparing and distributing the DD Form 214. The regulation directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement or discharge.
DISCUSSION AND CONCLUSIONS:
The applicant's record contains documents showing he used the SSN that is listed on his Social Security Card during his period of active service. It appears an administrative error occurred resulting in the incorrect SSN being listed on his DD Form 214. Therefore, it would be appropriate to correct his DD Form 214 to show his SSN as it is listed on his Social Security Card.
BOARD VOTE:
____x___ ____x___ ____x____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
_______ ________ _________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 3 of his DD Form 214 the current SSN entry and replacing it with the SSN listed on his Social Security Card.

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his correct social security number (SSN). On 21 July 1977, the applicant submitted a DD Form 149 (Application for Correction of Military or Naval Record under the provisions of Title 10, U.S. Code, section 1552) requesting a correction to his DD Form 214 to show his SSN as "XXX-XX-1XXX." The DD Form 214 he was issued at the time shows his SSN as "xxx-xx-3xxx." The applicant's military record contains documents showing the same SSN as shown on his SSA printout and initial DD Form 214. The only document in the applicant's record showing a different SSN is his DD Form 214 for the period ending 27 January 1971.

Application for correction of military records (with supporting documents provided, if any). There are no documents in his available record, other than the DD Form 214, that show his SSN as xxx-xx-3xxx. DISCUSSION AND CONCLUSIONS: The applicant's record contains a DA Form 41 that was prepared immediately after his induction at shows the same SSN as it appears on his Social Security card.
ARMY | BCMR | CY2011 | 20110011325
His DD Form 4 (Enlistment Record Armed Forces of the United States), dated 30 September 1965, does not list his SSN and only shows his Army service number (ASN). Item 3 (SSN) of his DD Form 214 shows his SSN with the last four digits as "5XXX." This error was compounded when his DD Form 214 was completed using this SSN.
ARMY | BCMR | CY2012 | 20120001568
Application for correction of military records (with supporting documents provided, if any). The evidence of record clearly shows his SSN as "XXX-XX-2XXX." As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 3 on his DD Form 214, dated 4 August 1969, to show the SSN as it is listed in item 3 on his DD Form 214, dated 24 April 1967.

The applicant requests correction of his DD Form 214 (Armed Forces of the Unites States Report of Transfer or Discharge) to show his Social Security Number (SSN) as xxx-xx-4xxx instead of xxx-xx-1xxx. Item 3 (SSN) of the DD Form 214 he was issued at the time shows his SSN as xxx-xx-1xxx. However, at the time of his enlistment processing, his SSN was recorded in his military records as xxx-xx-4xxx.
ARMY | BCMR | CY2013 | 20130021228
Application for correction of military records (with supporting documents provided, if any). The evidence of record shows his SSN consistently appeared as "XXX-XX-1XXX" on documents in his records throughout his period of military service. Based on his Social Security Card, his SSN is currently "XXX-XX-4XXX"; however, it is not the SSN he used when he served on active duty, and this does not change the conditions and circumstances that existed at the time his service records were created.
